A statutory declaration is a legally binding written statement of fact made for official or legal purposes.

The person making a statutory declaration (the declarant) must sign the document in the presence of an authorised witness.

Am I an authorised witness?

An authorised witness for South Australian statutory declarations is somebody prescribed in the Oaths Regulations 2021 who must have a connection to South Australia. This includes:

  • Justices of the Peace
  • police officers
  • court registrars
  • bank managers
  • medical practitioners
  • accountants.
